Building Blocks: R (on the application of Lewis) v Redcar and Cleveland Borough Council [2010]

In this Building Blocks episode, Richard discusses how town and village greens became a very prevalent way of stopping developments with regards to R (on the application of Lewis) v Redcar and Cleveland Borough Council, a UKSC case from 2010 and s.15 of the Commons Act 2006. In this case, CBC wanted to build 300 houses, along with leisure facilities on 18 acres of land due to the Golf Club's lease over the land coming to an end - and so, the a group acting on behalf of the local residents moved to register the land as a village green on the basis of the lengthy period of continued recreational use, therefore stopping the development.
